This document establishes the rules and conditions applicable to all visitors and users of the vinyllaz.com website. By using the website, including accessing, browsing and/or placing an order, you accept the Terms and Conditions provided in this document, as well as all effects and consequences arising therefrom. We recommend that you read these Terms and Conditions carefully before using the website. If you do not agree with any of the provisions, please reconsider using our services.

2. Products Offered

• We exclusively sell NEW vinyl records, factory-sealed and delivered in original packaging. • Exceptions: In rare situations, certain titles may be received from distributors without seal or with damaged seal. In this case, the condition will be clearly indicated on the product page (ex: "New – without seal" or "Partially damaged seal"). • We recommend checking the technical specifications and compatibility information available on the manufacturer's official website before placing an order, to ensure the product meets your needs.

3. Product Information and Displayed Content

• Product descriptions, cover images (front and back) and other information presented on the site are obtained from authorized sources, such as official distributors, authorized suppliers and dedicated public platforms, such as Discogs. • Links to music streaming platforms, such as Spotify, are provided for user convenience and information and redirect to content hosted and managed by third parties. We specify that the audio and track list available through these links may differ from the physical vinyl record version. • The cover images (front and back), created and edited by vinyllaz.com, are valid for all vinyl variants, whether standard black or colored. • Vinyl colors may vary from those shown in photos, and shades and tones may be influenced by lighting conditions or production characteristics. • Differences may appear between displayed images and actual products, including covers or other visual elements. • The site administrator makes efforts for the accuracy of information, but cannot guarantee the complete absence of errors or discrepancies that may result from supplier changes, human errors or other circumstances. • We recommend checking all available details carefully on each product page before placing an order.

• Online bank card (through secure Stripe processor) – Online payment with card is carried out through the Stripe platform, one of the most secure international payment processing solutions. Card data is not collected, processed or stored at any time by vinyllaz.com; they are entered directly into Stripe's secure system. • Cash on delivery (payment in cash upon delivery) • Bank transfer (advance payment, based on issued proforma) The order will be processed after payment confirmation or after acceptance of cash on delivery payment.

6. Delivery

• We deliver on the territory of Romania (currently) through the Colete-Online.ro platform, which compares and intermediates offers from the most well-known courier companies, so you always have the most advantageous option. • Estimated delivery time varies depending on the chosen service, usually between 2 and 5 working days from order confirmation. • Shipping cost is displayed before order completion; free shipping promotions may exist. • All packages are packed exclusively in eco-friendly materials, contributing to environmental protection, without compromising product integrity during transport. • Please check the package integrity upon receipt and immediately report to the courier any visible packaging damage. Subsequent complaints must be sent to both the courier and vinyllaz.com within 24 hours of receipt. • If the package is not picked up by the customer or delivery is repeatedly refused without a justified reason, return shipping costs may be withheld, and processing of future orders may be restricted. • For returns, we recommend using the same courier service used for the initial delivery, to ensure efficient and correct return processing.

7. Return Policy

In accordance with Government Emergency Ordinance no. 34/2014 regarding consumer rights in distance contracts, you have the legal right to withdraw from the contract, without stating reasons, within 14 calendar days from the date you came into physical possession of the product. Vinyllaz voluntarily extends this period to 30 calendar days, to offer you more flexibility and confidence when shopping. Return conditions: • Attention: the right of return does not apply to sealed audio-video products (including vinyl records) if they have been unsealed after delivery. The warranty does not cover damages caused by improper use or unsealing. • The product can only be returned if it is in its original condition, factory-sealed, and the seal is intact, without traces of damage, tearing or partial detachment. • Products marked on the Site as "New – without seal" or "Partially damaged seal" are not eligible for return, as their condition was explicitly accepted at the time of purchase. • For reasons related to product protection and copyright, unsealed vinyl records cannot be returned. This exception is provided by art. 16 lit. i) of GEO 34/2014. • To initiate the return, send an e-mail to info@vinyllaz.com specifying the order number; you will receive the necessary instructions and return form. • Return shipping cost is borne by the customer, except in cases where the product was delivered incorrectly or has a manufacturing defect. We recommend using the same courier service through which the initial delivery was made, for more efficient management. • Refund of the returned product value is made through the same payment method used initially, within a maximum of 14 calendar days from receipt and verification of the product by Vinyllaz. • The right of return applies exclusively to natural persons. Legal entities do not benefit from this right. • We recommend keeping the original packaging intact and not unsealing the product if you intend to return it. Additional note: In the case of repeated returns considered unjustified or abusive, Vinyllaz reserves the right to refuse processing subsequent orders from the respective customer.

8. Warranties and Complaints

• Products sold by Vinyllaz benefit from warranty conditions in accordance with current legal provisions. • All products are visually checked before shipment. If you receive a disc with a manufacturing defect, please notify us within 48 hours of receipt, attaching relevant photos. • We will propose, at your choice: – replacement of the product with the same title (if available); – replacement with another title chosen by the customer: • if the new title has a higher price, the customer will pay the difference; • if the new title has a lower price, the remaining difference will be refunded; – or full refund of the returned product value, if none of the above options is possible. • Liability regarding legal conformity warranty: Vinyllaz assumes liability for product nonconformity if it occurs within 2 years of delivery. The consumer has the obligation to inform Vinyllaz about the nonconformity within 2 months of discovering the problem. • According to legislation, for the first 6 months from delivery, any nonconformity is considered to have existed at the time of delivery, except in cases where this presumption is incompatible with the nature of the product or the defect. After this period, the burden of proof falls on the consumer.

9. Data Protection and Account Security

The Operator (HODIȘ IONEL LAVINIU – Sole Proprietor), hereinafter referred to as "Operator", respects the provisions of Regulation (EU) 2016/679 on the protection of natural persons with regard to the processing of personal data (GDPR). Personal data collected through the www.vinyllaz.com website is used exclusively for order processing, invoicing and related communications. You have the right of access, rectification and erasure of data, in accordance with the law. For more details on how your data is processed and protected, please consult the Privacy Policy. Access to the site and placing orders can be done both without a user account, as well as through the optional creation of a personal account. Account creation provides additional benefits, such as saving delivery data, viewing order history or subscribing to the newsletter. Account creation implies prior acceptance of these Terms and Conditions and the Privacy Policy. We recommend re-reading these documents periodically, as they may undergo changes; if you do not agree with the updated version, please stop using the site services. By registering the account, you assume responsibility for all activities carried out through it. We recommend keeping your password and any other access data safe. If you suspect the compromise of your account security, please inform the Operator immediately. We are not liable for any damages caused by unauthorized use of the account. Vinyllaz reserves the right to close user accounts or restrict access to certain functionalities in justified situations, at its discretion. Products can only be purchased by persons aged at least 14; in the case of minors under this age, purchase can only be made through a parent or guardian.

The Vinyllaz website administrator (vinyllaz.com) reserves the right to modify the content of this agreement at any time, without prior notice to the persons using it (hereinafter referred to as "Users"). "Users" means persons who access and/or use the services provided through the website. Users will have permanent access to the terms and conditions of service use, to be able to consult them at any time. The applicable version is the one published on the Site at the time of order placement.

11. Applicable Law and Service Availability

By using the vinyllaz.com website, the user accepts that these Terms and Conditions, as well as any dispute arising between users and the site administrator or its collaborators, are governed by current Romanian legislation. In case of conflicts, the parties will try amicable settlement. If this is not possible, disputes will be resolved by the competent courts in Romania. The vinyllaz.com website administrator reserves the right to modify, temporarily suspend or definitively terminate, totally or partially, any functionality, page or service offered through the website, at any time and without prior notice. You agree that vinyllaz.com and its operator will not be liable to you or to any third party for any modification, suspension or interruption of the website functionalities.
